Our commitment to your privacy
We understand that when it comes to health and wellness, the information you share with us can be deeply personal. Whether you are enquiring about personal training, joining a group wellness program or simply browsing our website, we treat your information with care, transparency and respect.
.nativeInformation handled with discretion
Every member of our team is expected to handle personal information responsibly, and health-related details are shared strictly on a need-to-know basis so that we can keep you safe while respecting your confidence.
The Privacy Act and the Australian Privacy Principles
This policy explains how we manage personal information in accordance with the Privacy Act 1988 (Cth) (the Privacy Act) and the 13 Australian Privacy Principles (APPs) contained within it.
Because we provide a health service and hold health information, the Privacy Act applies to our operations. Health information is treated as sensitive information — a category that attracts a higher standard of protection under the APPs — and we handle it accordingly.
What personal information we collect
Depending on how you interact with us, we may collect:
- your name, email address and suburb or postcode;
- the details you include in an enquiry, quote request or booking form on this website;
- health and wellbeing information you choose to share with us — for example, details about injuries, medical conditions, medications, mobility or fitness goals — so that we can design safe, effective programs for you;
- attendance and progress records relating to sessions or programs you take part in;
- billing and payment information, processed securely through third-party payment providers (we do not store full card numbers on our own systems);
- technical information such as your IP address, browser type, device type and the pages you visit on our website.
We collect only the personal information that is reasonably necessary for one or more of our functions or activities (APP 3).
Sensitive information and health information
Sensitive information includes health information. We will only collect sensitive information where:
- you have given your consent; and
- the collection is reasonably necessary for delivering our health, fitness and wellness services,
or where the collection is otherwise permitted or required by Australian law.
If you choose not to provide certain health details, we may be limited in the services we can safely provide. For example, we may ask for medical clearance before you begin certain exercise programs, so that we can meet our duty of care.
How we collect personal information
Wherever reasonable and practicable, we collect personal information directly from you, including:
- when you complete a form on this website;
- when you email us at ceo@primepulseaustralia.site;
- when you attend a consultation, fitness assessment, training session or wellness program.
We may also collect limited information automatically when you browse our website, through the cookies and analytics tools described below. Where we collect personal information about you, we will take reasonable steps to notify you of the matters set out in APP 5, including the purposes of collection and how you can contact us.
Why we collect, hold, use and disclose personal information
We collect, hold and use personal information to:
- respond to your enquiries and prepare quotes;
- plan, deliver, monitor and evaluate our fitness and wellness programs;
- manage bookings, attendance, invoicing and account administration;
- communicate with you about appointments, programs and service updates;
- maintain accurate business, safety and progress records;
- meet our legal, insurance and workplace health and safety obligations;
- improve our website, services and client experience.
We will not use or disclose your personal information for another purpose unless you would reasonably expect us to do so, you have consented, or the use or disclosure is permitted by the APPs (APP 6).
Direct marketing
We will not send you marketing communications without your consent, unless an exception under APP 7 applies. Every marketing email we send includes a simple, free way to opt out, and you may withdraw your consent at any time by emailing ceo@primepulseaustralia.site. Once we receive your opt-out request, we will stop sending you marketing material promptly.
Disclosure of personal information
We do not sell, rent or trade your personal information. We may disclose it to:
- suitably qualified trainers, coaches or practitioners engaged to assist in delivering your program, strictly on a need-to-know basis;
- professional advisers (such as our accountant or insurer) where reasonably required;
- third-party service providers who host our website, email or booking systems;
- payment processors for billing purposes;
- medical or emergency personnel where we reasonably believe it is necessary to lessen a serious threat to someone's life, health or safety;
- government bodies, regulators or courts where required or authorised by Australian law.
Any disclosure is limited to what is reasonably necessary for the purpose (APP 6).
Overseas disclosure
Some of our service providers, such as email, cloud hosting or analytics providers, may store or process data on servers located outside Australia. Where personal information is likely to be disclosed to an overseas recipient, we take reasonable steps — including contractual safeguards — to ensure the recipient handles that information in a manner consistent with the Australian Privacy Principles (APP 8).
How we protect your information
We take reasonable steps to protect the personal information we hold from misuse, interference, loss, and from unauthorised access, modification or disclosure (APP 11). These steps include:
- encrypted connections (HTTPS) across our website;
- password protection, access controls and limited staff access to records;
- secure storage of digital and paper records;
- using reputable providers with strong security practices for hosting, email and payments.
We also take reasonable steps to destroy or permanently de-identify personal information once it is no longer needed for any lawful purpose, unless we are required by law to retain it — for example, certain business and insurance records.
Access to and correction of your information
You have a right to request access to the personal information we hold about you (APP 12) and to ask us to correct information that is inaccurate, out-of-date, incomplete, irrelevant or misleading (APP 13).
To make a request, email ceo@primepulseaustralia.site. We will respond within a reasonable period — generally within 30 days — and there is no charge for making a request. In limited circumstances, we may decline a request where permitted by the Privacy Act; if so, we will explain our reasons and how you can seek a review.
Data breach response
If a data breach occurs that is likely to result in serious harm to any individual whose information we hold, we will assess the breach promptly and, where required under the Notifiable Data Breaches scheme, notify the affected individuals and the Office of the Australian Information Commissioner (OAIC) as soon as practicable, including recommendations about the steps you should take.
Making a privacy complaint
If you have concerns about how we have handled your personal information, please contact us first at ceo@primepulseaustralia.site so we can understand your concerns and work towards a resolution. We take all privacy complaints seriously and will acknowledge your complaint and respond within a reasonable timeframe.
If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner via www.oaic.gov.au.
Anonymity and pseudonymity
Where it is lawful and practicable, you may deal with us anonymously or using a pseudonym — for example, when browsing our website or reading general service information. However, to deliver personalised health, fitness and wellness services safely, we will usually need to identify you and collect relevant health details.
Links to other websites
Our website may contain links to third-party websites. Those websites have their own privacy policies, and we are not responsible for how they collect, use or protect your information. We encourage you to review the privacy policy of any website you visit through a link from ours.
Changes to this policy
We may review and update this Privacy Policy from time to time to reflect changes in our practices, services or legal obligations. The current version will always be published on this page, and the "Last reviewed" date above indicates when it was most recently updated.
